Tutor terms
These terms are for tutors who apply to teach on Spark Tutor. You are the provider of the lesson. They sit alongside the Terms of Service.
This document is available in English and Polish; both language versions have equal force. In case of any discrepancy, the interpretation more favourable to the consumer applies.
You provide the lesson
You are the provider of the lesson. The lesson contract is between you and the learner, or the parent who books for themselves or for a family member. You are responsible for the lesson, for its quality, and for cancellation where these terms and the refund policy put that on you. Complaints from learners go to Spark Cart, which will ask you for your input.
You issue the learner’s receipt or invoice for the lesson. Lessons are exempt from cash registers until 31 December 2027. That exemption does not move this duty off you. You are also responsible for your own taxes.
You cannot be booked until Spark Cart approves your profile.
Payment collection
You appoint Spark Cart Sp. z o.o. as your limited agent to collect the lesson price from the learner through Stripe, and to pay refunds on your behalf under the refund policy. Payment to Spark Cart counts as payment to you. Spark Cart is not the provider of the lesson. Spark Cart also guarantees learners' consumer rights on its own account (see the Terms).
Commission
Spark Cart’s commission is 20% of the lesson price. The person who books pays that lesson price. The commission is not added on top. You receive 80%. Spark Cart sends you a monthly commission statement; a VAT invoice where the law requires one or on request.
While Spark Cart is exempt from VAT under article 113(1) of the Polish VAT Act, the VAT invoice states that exemption. If that exemption no longer applies, the VAT invoice will show the VAT that then applies.
Tax data and DAC7
Spark Cart must collect, and you must provide: your legal name, address, country of residence, date of birth, whether you act as a business or as a private individual, your NIP, PESEL, or foreign tax identification number, your EU VAT number if you have one, your IBAN, and your email.
Spark Cart reports paid tutors under DAC7. If required tax data is still missing 60 days after Spark Cart first asks for it, Spark Cart can withhold payouts.
Lessons
Lessons take place by video call (Teams, Meet, Skype) or in person. Spark Tutor does not host the lesson.
If you cancel, or you do not attend, the person who paid receives a full refund. A cancellation they make 24 hours or more before the start is also a full refund. Inside 24 hours, their cancellation is not refunded, subject to the learner’s statutory right of withdrawal (see the Terms). If a consumer withdraws during a lesson, they pay only for the part already delivered, and Spark Cart’s commission is reduced in the same proportion. Spark Cart pays that refund on your behalf.
